These terms and conditions are in relation to the use of our online shop. The services Marine Rigging Services supply away from this element of the business is governed by a separate but equivalate set of terms and conditions. Please take the time to ensure you are familiar with the relevant terms to the service or product you wish to use.

This website is operated by Marine Rigging Services LTD. Throughout the site, the terms “we”, “us”, “our” and “MRS” refer to Marine Rigging Services LTD.

By visiting our site and/ or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”),

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website.

1 – HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

1.1 - Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

1.2 - After you place an order, you will receive an e-mail from us acknowledging that we have received your order via a “confirmation of payment” email.  However, please note that this does not mean that your order has been accepted. Your “order confirmation email” will confirm stock allocation for your order.

1.3 - If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site as referred to in clause we will inform you of this by phone or by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible.

2 – GENERAL CONDITIONS AND RIGHT TO CANCEL

2.1 - Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with Marine Rigging Services within a period of 30 calendar days. This outlined in our returns policy. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched, then you will need to either refuse delivery or return the goods using the directions outlined in our returns policy. Refunds will aimed be processed within 3-5 days of receipt of the product/products/complete order. Goods must be returned before a refund will be processed and the product must be returned in its original condition.

2.2 - We reserve the right to cancel an order to anyone, for any reason, at any time. Examples of why me might. We have insufficient stock to fulfil your order and an alternative is not suitable. We are unable to obtain payment. We do not deliver to your area. A product fault or an error in the product description has been identified.

2.3 - You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

2.4 - We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. If we make a change to or cancel an order, we will attempt to notify you immediately using the contact details given by the consumer.

2.5 - We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

2.6 - You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

3 – ACCURACY AND WEBSITE ERROS

3.1 - We endeavour to give the most accurate, most recent, and most reliable information on our website. However, occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice, including after you have submitted your order. Any of these types of error are completely unintentional and we would aim to apologise for and correct these inaccuracies immediately.

3.2 – While the risk of inaccuracies is minimal we do express the material on this site is provided for general information only and should not be relied upon completely for making decisions. Any reliance on the material on this site is at your own risk. Please contact MRS directly if you have any queries or spot any questionable information.

3.3 - We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

4 – PRODUCT PRICING

4.1 - In the very rare event of a product price discrepancy, the purchase price of the product on the Marine Rigging Services website prevails over the price that may appear elsewhere. You will always be charged the price that is displayed on the checkout page.

4.2 - We try to ensure that all pricing on the website is accurate, but occasionally an error may occur, and goods may be incorrectly priced. If we discover that a pricing error has been made, we reserve the right to suspend your order and contact you to ask whether you wish to continue with the order at the correct price. We are not obliged to supply goods at the incorrect price.

5 – VALUE ADDED TAX (VAT)

5.1 - VAT is charged on all UK orders.

5.2 - Any order that leaves the UK will now be sent EXCLUDING VAT. Your order will be likely subject to import duties and taxes which are applied by the destination’s local authorities. We have no control over these charges and cannot predict their amount.

5.3 - All queries relating to VAT should be made to the HM Customs on 0845 010 9000.

6 – PHONE PAYMENTS

6.1 - Orders over £100 cannot usually be taken over the phone due to the risk of fraud. If the order values exceed this, we will normally ask for a bank transfer or for the payment to be made via our online check out.

7 – PRODUCT DISPLAY

7.1 - We have made every effort to display the products featured as accurately as possible. However, the colours we use, as well as the display and colour capabilities of your computer monitor, may greatly affect the colours you actually see on the screen. Marine Rigging Services cannot be held responsible for any limitations of your monitor and cannot guarantee that your monitor’s display of any colour, texture, or detail of merchandise will be accurate / the same as the actual product.

8.1 - Certain content, products, and services available via our service may include materials from third parties.

8.2 - Third-party links on this site may direct you to third-party websites that are not affiliated with us. 8.3 - We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

9 – PERSONAL INFORMATION

9.1 - Your submission of personal information through the store is governed by our Privacy Policy. Please take the time to review our Privacy Policy in full before giving any personal details.

10 – PROHIBITED USES

10.1 In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. 11 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

11.1 - Given the unpredictability of technology and the online environment, Marine Rigging Services does not warrant that the function or operation of this website will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful elements.

11.2 - Your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. We reserve the right to do this without notice to you.

11.3 - You agree that your use of, or inability to use, the service is at your sole risk.

11.5 - We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from which is beyond our reasonable control. This condition does not affect your statutory rights.

12- COMPLAINTES

12.1 - We operate a complaint handling procedure which we will use to try to resolve disputes when they first arise: please contact MRS if you have any complaints or comments immediately.

12.2 – Any complaint regarding to the service provided must be submitted within 30 days of receiving your order. Complaints made after this time may not be handled.

13 – TERMS AGREEMENT

13.1 - These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

13.2 - Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

14 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.

15.2 - We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
